Legal Framework of Paternity

There are a few legal frameworks which determine paternity. Generally, these frameworks rely on a number of factors such as how the alleged father and mother were related to one another at the time of conception, whether the alleged father was present during the pregnancy, and whether there were any signs of child abuse or neglect.

In most cases, it is necessary for an alleged father to be served with a notice of paternity in order to have his rights determined. This notice will usually state the date of conception, the name(s) of the parents involved, and other relevant information. If an alleged father does not respond to this notice within a certain period of time, then his rights may be determined automatically based on certain factors.

If an alleged father does not have custody or visitation rights over his child/ren, he may still have legal rights if he can demonstrate that he is either genetically or legally responsible for the child/ren's existence.
